Counterfeit Goods

Counterfeiting infringing goods has become a global problem. Every country in the world is spared no effort to find the answer to the problem.

Recently, a number of European countries have issued a series of measures to combat counterfeiting and infringement.

Belgium Belgian law enacted in May this year to combat product counterfeiting and infringement of intellectual property rights has been formally implemented since October 1st. It is responsible for coordinating the Ministry of economic affairs, the Ministry of Finance (including customs) and the federal police department for the law enforcement body and the Ministry of economic affairs.

Compared with the government, in recent years, product counterfeiting and infringement of intellectual property rights have become a worldwide problem, showing the characteristics of diversification and specialization, infiltrating into all areas of economic life, not only damaging enterprises and investors in R & D and innovation, but also causing great harm to consumers' safety and health at the same time, the destruction of fair competition, endangering the investment environment and employment, resulting in the loss of state revenue, which is a serious crime.

The law defines the criminal nature of product counterfeiting and intellectual property infringement, strengthens the enforcement and enforcement measures of Customs in Belgian territory, and provides that the law enforcement authorities can initiate investigations without complaints from owners of intellectual property rights, thereby protecting the legitimate rights and interests of intellectual property owners.

The offenders will be held criminally liable, ranging from 3 months to 3 years, with a fine ranging from 100 to 100 thousand euros.

Enforcement measures also stipulate that law enforcement agencies can provide conciliatory solutions to offenders to compensate the legitimate owners of intellectual property rights.

The number of counterfeit products is more than a certain number of passengers, and if they are suspected of commercial profits, they will also be punished.

Vinso Kalgov, director of the Macedonian General Administration of Macedonia, said: "in 2007, Macedonian customs confiscated 1 million 460 thousand counterfeit goods.

This is an astonishing increase compared with the 70 thousand counterfeit commodities in 2006.

In 2006, there were 47 cases involving intellectual property rights, up to 207 in 2007.

800 thousand counterfeit goods have been destroyed, most of the counterfeit goods are NIKE, ADIDAS, HUGOBOSS, NOKIA and LANCOME, and other famous brand products.

Almost 62% of the counterfeit goods are in Macedonia.

Macedonian experts say the counterfeit goods in Macedonia are comparable to other neighbouring countries.

Fortunately, a small country in Macedonia does not have a large container unloading port, so the counterfeit goods are smaller and the counterfeit goods found so far in Macedonia are not yet available.

According to experts, apart from the price, counterfeit goods are most easily distinguishable from their packaging and misspelled trademarks.

The most difficult to find are counterfeit sneakers from China, because they often use genuine packaging boxes.

As part of combating counterfeit goods, the Macedonian customs organized a publicity campaign to protect intellectual property in September 2007 and October.

In October 3rd, the Czech government discussed and passed the intellectual property protection situation document, including the anti piracy and anti counterfeiting action plan of Czech.

The Czech government has decided that the destruction of intellectual property rights, like other criminal offences, must not be tolerated. It is proposed that joint action be taken by all relevant departments to combat piracy.
